BICYCLE LANES AND BIKING SAFETY IN MIAMI-DADE

Bicycle lanes are not always welcomed with open arms in and Coral Gables is one of them many Miami-Dade County communities that oppose them. Since 2004, the city commission has rejected proposals to build bike lanes; mainly from complaints on behalf of the disapproving neighbors. In 2014, a plan was presented to build 27 miles of new bike lanes, sidewalks and crosswalks, but that never developed. In 2018, residents voiced their opposition at a commission meeting to add bicycle lanes along Riviera Drive. According to Robert Ruano, the chair of the Bike Walk Coral Gables nonprofit; “There’s very little really safe bike infrastructure in the city right now to actually increase people using the road for biking safely.” For 2020, a new proposal aims to create bike lanes & broaden sidewalks along Alhambra Circle from Coral Way to the University of Miami. This 2.3-mile stretch could result in the loss of trees, according to concerned residents; thus, the plan for more bike lanes may be scrapped once again. However, Silvia Pinera-Vazquez, an attorney residing on Alhambra Circle, is pushing for bike lanes through an open letter to city officials. A FLORIDA SCHOOL TELLS TEACHERS TO STAY CLEAR OF STUDENTS

MIAMI — Across the United States, public health officials have emphasized the vital need for teachers and faculty to get vaccinated with the COVID vaccine, given the importance of returning to face-to-face classes.
Though most teachers and school officials have heeded the advice of health officials and received the covid-19 vaccine, there is one school within the Miami Design District that has refused to have its faculty vaccinated.
The Centner Academy co-founder Leila Centner, told the school staff to forget about returning to work this fall if they voluntarily chose to get the COVID-19 vaccine, adding that in the event they did get the coronavirus vaccine, they would be kept away from students.
This results from the school’s co-founder’s belief that COVID vaccine recipients can spread the virus to healthy people. These claims are based on incidents were female staff were affected negatively after coming into contact with vaccinated people. According to Centner, teachers that have been vaccinated are not allowed back until clinical trials have been finalized, and that depends if their position is still available once that happens.

Premises Liability and Crime in Apartment Buildings

When it comes to crime within an apartment building or premises that houses people, the victim of a robbery or other crime, may be able file a lawsuit for security negligence if there is substantial proof that the building or premises operator acted without care and didn’t take the necessary measures to help prevent an act of crime. In some cases, security negligence may stretch beyond the interior of the apartment complex and include the parking lot or any other area set within the premises. The landlord or building operator is responsible for providing an environment that is relatively safe for its occupants no matter where they are or when. This can be done by making sure entryways are secured by working locks and windows are intact, free from cracks or busted locks. In the event that the property operator was aware that a door or window didn’t close properly or locks were busted, and an individual enters to commit a crime, the victim may have justifiable right to a personal injury claim based on negligence by the landlord or property manager.

ROLLOVER CRASH SENDS TIGER WOODS INTO SURGERY

Los Angeles: Tiger Woods, the former five-time masters golf champion, suffered serious personal injuries and went into surgery following a rollover crash early Tuesday morning in Los Angeles. According to reports, Tiger Woods lost control of his SUV after striking the median while travelling northbound on Hawthorne Boulevard, which is known for its notoriously steep and winding conditions. On this occasion, Wood’s vehicle rolled over several times after crossing into the opposite lane and coming to a full stop almost a thousand feet from the initial crash. At the accident scene, Woods was reported to be conscious and calm despite his multiple injuries to both his legs. He was taken to the Harbor U.C.L.A. Medical Center and rushed into surgery to repair multiple broken fractures in right leg and ankle. Though unclear what caused the accident, the local sheriff believes that Woods was driving above the speed limit on a downhill portion of road when struck the median and lost control. Fortunately, Woods was reported to have been wearing his seatbelt and that the vehicle’s airbags deployed successfully, perhaps saving his life. Although the vehicle suffered extensive damage, Woods was able to be removed from the vehicle without the use of the Jaws of Life. Woods is reported to be recovering well after and in stable condition following his emergency surgical intervention.

TALLAHASSEE —Florida Senators are full steam ahead with yet another proposal to get rid of the no-fault insurance system, otherwise known as PIP (Personal Injury Protection) for Florida motorists. If successful, this would radically change the way insurance providers, policy holders, and personal injury accident attorneys handle insurance claims for compensation following motor vehicle accidents.

The proposed bill (SB 54) aims to eliminate no-fault insurance and have it replaced by bodily injury coverage (see Insurance Policies for Florida Motorists). However, it must first must be passed by the Senate Judiciary Committee and face a probable lawsuit on behalf of personal injury attorneys that oppose the change.

At present, only Florida and one other U.S. state have yet to have no-fault insurance replaced by bodily injury protection, which aims to provide better coverage and lower the cost to insurance providers in the event of a motor vehicle accident that results in personal injury to drivers, passengers, and other third-party victims

SWIMMING POOL ACCIDENT LAWYER IN MIAMI

HOTEL POOLS – SWIM AT YOUR OWN RISK?

A Florida of Appeals found a Miami Beach hotel not liable for the pool drowning death of a guest that drowned with no lifeguard on duty.

According to the court, the hotel operators and administration was found not negligent in the wrongful death claim brought on by the victim’s representative, which alleged that the hotel acted negligently by not having trained staff or provide warning of the absence of a lifeguard on duty. According to the court ruling, the hotel was not legally bound to having a lifeguard on duty, which raises question as to the responsibility of hotel operators to safeguard the lives of swimmers and guests.

Pool goers are expected to act responsibly and avoid negligent acts which can endanger their lives or pose risk of injury when poolside without the presence of a lifeguard. Also, hotel pool goers are reminded to respect pool hours and swim at the own risk after dark.

Swimming pool accidents do not only include drowning or injury, but any other negligence by pool operators which lead to losses to guests.
