Hogares de Ancianos y El COVID-19

Geriatric-Lawyer-Miami-300x300

NURSING HOME VISITORS IN MIAMI-DADE

Since March, Florida residents have been prohibited from seeing their relatives & loved ones residing in long-term care facilities. On Tuesday, Gov. Ron DeSantis stated that the time for that to change has come despite the growing number of COVID-19 cases flooding the state of Florida’s healthcare system and nursing home across Miami-Dade. The governor of Florida expressed understands the concerns of Florida residents having loved ones & relatives in nursing home must feel & stated the need for a light at the end of the tunnel. Thus, the Florida governor is planning policies that would allow people to visit nursing home & long-term facility residents when certain criteria apply. A new committee is being set up to examine policies that may allow visitors. According to a former Florida long-term care ombudsman, believes that isolation with no visitation is a major problem throughout Florida, both for the residents and loved ones because of concerns of negligent care or lack of information about state of their loved one. However, the former ombudsman agrees that now is not the time to allow visitors in nursing home or assisted living facilities in Miami-Dade or Florida. Meanwhile, facility operators are doubtful that now is the time, as the elderly are the most at risk of death from

COVID-19 or related causes.

Toxic hand sanitizer leads to blindness and death

According to the CDC, a toxic hand sanitizer caused the wrongful death & personal injury to 15 people to suffer methanol contamination. The U.S. Food & Drug Administration (FDA) had alerted consumers that some hand sanitizers contained the poisonous chemical, which can be fatal upon human consumption. Since May, over a dozen people have been treated, with 4 of those that somehow ingested the hand sanitizer suffering wrongful death. Consumers fall ill & die from consuming tainted goods regularly. Of the 11 victims, 3 where left almost blind, with over 12 product liability negligence victims suffering seizures while in hospital. Over 60 cases have been reported, with some alleged to be kids that may have ingested methanol tainted hand sanitizer accidentally. People struggling with alcohol abuse may intentional consume hand sanitizers. Also, the boom in alcohol-based hand sanitizers to fight the coronavirus, has led to users to inadvertently intake it through contact with the hands or facial covering. For this reason, the hand sanitizer in question & its manufacturer may be liable for injury or wrongful death from methanol-tainted hand sanitizer. The CDC notes nausea, abdominal pain, dizziness, or seizures. Severe symptoms may result in blindness & death. CRUISE SHIP WORKERS & COVID COMPENSATION.

MIAMI: Following months of working without pay, Bahamas Paradise Cruise Line crew workers may soon receive compensation from a class-action suit filed in Miami. The personal injury attorney representing the crew members aboard the company’s Florida-based ships, settled on a fee that would pay 275 staff members $875,000 in compensation. The class-action suit holds Bahamas Paradise Cruise Line liable for back wages that went unpaid ever since the U.S. government cancelled all cruises on March 14th. Meanwhile, crew members were asked to remain onboard and continue to carry-out their duties regardless of whether there were passengers aboard or the two ships the cruise line operates: The Grand Celebration and the Grand Classica. However, cruises never started back up and the crew remained aboard without pay and having to go out-of-pocket to cover their own essentials. Sadly, labor laws do not apply to cruise ship workers in the United States because the companies and ships are registered abroad (see Maritime Labor Convention of 2006).

As of March, cruise ship crews have experienced numerous unique hardships, as many have been confined to the ship on which they together with quarantined and COVID-19 infected passengers.

If you, a friend, or relative has suffered physical or mental injury while aboard a cruise, in Miami, the Perazzo Law Firm can help.
